can disney take pictures without permission?

Not sure where to post this but since it referres to the cog headquarters pictures that are used on the "front page" I guess it's ok.

Can the devs use pictures that are posted on this site without permission? Is this site run by disney? Just curious since most of the pix on the "front page" were posted to this site by members.

I personally see no problem with this and would consider it an honor to have my snap shots chosen but some may not.

I also forsee the possibility of a members "teaser trailer" being posted on the front page. If I was a dev I would appropriate it if it was in my legal rights. How would the creator fell about that if he wasn't asked?

I'm sure that Disney can use any and all of the pictures posted here because legally, they're Disney property, Disney copyright since the pictures came out of a Disney game.

Also, THIS site isn't run by Disney. It's a fan site.

As far as trailers go, it's up to Disney to decide if it's a copyright infringement. If they tell him not to use their pictures and/or footage, then I suppose they can. But as far as I understand I think he can't use that for personal gain, like to sell copies of it (not that he would, mind you). But I'm sure if Disney really wanted to crack down on us all posting pictures & making movies, I'm sure they would've done it a loooong time ago.

Just curious! The trailer I was reffering to is the member created trailer or teaser.

That's a good point though that all the pix are from disneys copyrighted online game. So, it's logical that they would reserve the right to use them if they wish. According to the "agreement" the toons we create belong to them also. That basically answers my question.

It's logical that it doesn't matter where these pictures are posted that they are property of Disney.

Typical RPG EULAs (End user license agreement, that big lawbot document you agreed to when you made your account) don't even allow you to post screenshots, edited or not, from their games. Disney's appears to be this way too, often the legal department errs on the side of caution though. Most of the time they don't care if you post screenshots on fansites, even doctored ones don't cause problems UNLESS they are doctored to show something that the game doesn't have and you try to pass that off as something that it does.

If you edit a screenshot for a sig or avitar, that's usually acceptable. Doing things like trying to make it look like a new area that doesn't exist (and not telling people that this is an edited image and that it's not in the game) would be the kind of thing they frown upon. Making your toon do bad things like adult postions, expressions or sayings, such as say your character drinking a ****, is another good way to get them to come after you, especially for a game like this targeted at kids.

If you post pictures on a fansite for that game (like here at TTCF) it's implied that the images are from the game, but if you post screenshots for a game in other places it's a good idea to mention that they are from Toontown and provide a link to http://www.toontown.com too.

The pics you take from the game are technically the property of the game company and not you. The EULAs usually say that even if you edit it it's still their property and not yours. So you can't sell images taken from a game, and the game company is allowed to use your edited or unedited pictures in almost any way they want.
